MEMO ON TRADEMARK REGISTRATION IN BRUNEI
I. REQUIREMENT DOCUMENTS

II. GENERAL TIME FRAME OF TRADEMARK REGISTRATION IN A SMOOTH CASE
The approximate time from application to registration (for a regular prosecution, without opposition) is 12 to 20 months, assuming that no Office Action is needed.
III. VALIDITY TERM
The duration of the protection of a trademark right is 10 years from the date of filling of the trademark, which may be renewed every 10 years.
For the renewal of a trademark registration, an application for the renewal should be filed with BruIPO and a renewal fee must be paid six months before the expiry of the registration. Late renewal can be made within a period not exceeding six (6) months after the expiration of the mark by paying an additional fee.
IV. PROCEDURE
1. Formal Examination
After the application is submitted, the Registrar will officially acknowledge the application and give a filing number. Application is examined for any deficiencies (formalities examination) and in accordance with the set requirements under the law.
2. Publication
After formal examination, the Registrar will accept the application and it will be published in the government gazette for opposition. If there is no opposition after three (3) months, the mark will proceed to registration. The deadline to oppose a trade mark application is three (3) months and it is non-extendable.
3. Registration
If the Trade Mark is not opposed during the Opposition Period, the Certificate of Registration will be issued. The registered mark will be published in the Trade Mark Journal.
